White House, EPA Move To Ease Mercury Rules

Critics say the EPA should regulate mercury under the provisions of the Clean Air Act, which call for much steeper and earlier emissions reductions than the agency has proposed. Christie Whitman, who headed the agency last spring when EPA staffers say they were told to forgo the normal analysis of the mercury proposal said Tuesday that she supported Leavitt's decision to order new studies. Bad Card Credit Credit Now, the White House and EPA Administrator Mike Leavitt are considering rescinding a December 2000 EPA ruling, which concluded that mercury emissions are a public health menace that requires power plants to meet a "maximum achievable control technology" (MACT) standard to sharply reduce toxic pollutants.

Fuel refiners will be required to produce cleaner diesel fuel under the new rules, which the EPA proposed a year ago. Also, Cummins Inc., Caterpillar Inc. and others, starting in 2008, will have to build engines that strip out more harmful particles in emissions linked to asthma and other serious respiratory ailments. EPA Administrator Mike Leavitt was to brief President George W. Bush on the rules later on Monday and finalize the rules on Tuesday, the EPA said in a statement.

But an agency spokeswoman said Tuesday that work on the mercury rule was ongoing and that no judgment "should be made until the rule is finalized in December." EPA officials said, at this point, they stand by their " trade" approach to regulating mercury, fired utilities to either clean their emissions or buy "credits" from those that do.
